Sweepstakes General Rules

The Following General Rules Apply to all Seattle Art Museum Sweepstakes:

1. NO PURCHASE IS NECESSARY TO ENTER. Details and qualifications for participation in this promotion may apply. Sweepstakes are subject to federal, state and local laws and are void where prohibited by law and are open only to U.S. citizens. Entrants must be at least 18 years old or older.
2. Sweepstakes entrants agree to abide by the terms of these Official Rules and by the decisions of the sweepstakes commissioners, which are final on all matters pertaining to the sweepstakes.
3. Winner need not be present to win.
4. Only one entry per person may be submitted. Winning entries will be randomly selected from all valid entries received. If an entry does not supply all the information deemed necessary to declare a winner, the entry will be deemed invalid and another entry will be selected. The Seattle Art Museum, other sweepstakes Sponsors, and their respective officers, directors and employees (collectively “Releasees”) are not responsible for entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in your email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees.
5. All prizes and components are not exchangeable or redeemable for cash, and are subject to terms and conditions of use as stated thereon. If the prize includes a trip, winner agrees to accept all blackout dates, space availability requirements, or other conditions or restrictions established by the Seattle Art Museum’s prize partner(s), such as hotels, airlines, trains, ships, etc. Winner agrees that acceptance of any trip taken as a prize from the Seattle Art Museum is entirely of their own initiative, risk, and responsibility, and winner and any travel companions may be required to sign a travel release form.
6. Additional Eligibility and Limitations. All sweepstakes winners must disclose his or her legal name, address, telephone number, date of birth and Social Security Number. Any winner found to have supplied false or misleading information may be disqualified from the sweepstakes and therefore forfeit the prize(s). Winner agrees Sponsors may use his or her name and image in publicity relating to the sweepstakes. Employees of the Seattle Art Museum and any and all parent, subsidiary, related and affiliated companies, and their respective officers, directors employees and agents and their dependents and immediate families, as well as employees of sweepstakes Sponsors and vendors, and employees of other broadcast stations are not eligible to participate or win.
7. Release of Liability. The Releasees shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions which arise out of and/or are in any way related to the prize(s), the receipt, use and/or enjoyment of the prize(s), and/or damages or losses related to the sweepstakes. Entrants release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from: the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel; or from any interaction with, or downloading of, computer Sweepstakes information. If a Sponsor pulls out of a sweepstakes for reasons beyond the Seattle Art Museum’s control, the Seattle Art Museum is not responsible for continuing the sweepstakes and may substitute prizes to fulfill obligations.
8. The Sweepstakes and all of the related pages, contents and code are copyright of the Seattle Art Museum. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
9. Website Sweepstakes. To enter a sweepstakes on a Seattle Art Museum website, entrants must provide all the information deemed necessary to declare a winner. No liability is assumed by the Seattle Art Museum for any technical malfunction, including of the Internet or individual computer systems. When entering a sweepstakes via an advertiser’s web banner or logo hyperlink, the Seattle Art Museum is not responsible for prize fulfillment or any aspect of the sweepstakes.
10. Determination of Winner(s). Final determination of all winners will be made solely by the Seattle Art Museum. All results are unofficial until winners respond to e-mail or telephone notification. Any winner found to have supplied false or misleading information may be disqualified from the sweepstakes and therefore forfeit the prize(s).
11. Transferability/Substitution of Prize. Prizes may not be traded or transferred. Substitutions of cash or equivalent, unless otherwise specifically stated in the sweepstakes rules, are not allowed other than a substitution that may be necessary due to the unavailability of a prize. If a concert, other ticketed event, gift certificate or coupon has been awarded as a prize and the concert, event, place of business, or product is postponed, rained out, cancelled or for other reasons beyond our control does not occur/exist, the Seattle Art Museum will not be responsible for replacing the prize. Prizes not redeemed by any expiration date printed on the prize are no longer valid and will not be replaced. In accepting a prize, the winner accepts to take the prize as outlined in the sweepstakes. If a change of the dates of a prize is an option, all additional expenses, change fees, etc. will be the responsibility of the winner. If the winner is not able or chooses not to accept the prize “as is”, the winner forfeits his/her prize. The Seattle Art Museum reserves the right to select another winner. Winner is responsible for all costs associated with travel to any venue or event for which a prize was awarded, unless otherwise specified.
12. Amendments to Rules. The Seattle Art Museum reserves the right to amend the sweepstakes dates and rules at any time. If any portion of the above rules is determined to be unenforceable due to local or state laws, all other portions of these official rules remain in effect. In the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsors’ reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, Sponsors have the right, in their sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select a winner by such method as Sponsors in their sole discretion shall consider equitable; and in the event a trip has already commenced, to terminate the trip and return the winner(s) to the airport of origin as soon as reasonably possible.
13. Postponement or Cancellation of Sweepstakes. The Seattle Art Museum reserves the right to postpone or cancel a sweepstakes without notice. In such instances, the sweepstakes prize may be awarded at a future date at the Seattle Art Museum’s discretion.
14. All information contained in entries will be treated in accordance with the Seattle Art Museum’s privacy policy.
15. Taxes are the sole responsibility of the winner.
